This website is operated by Maxmyer. Throughout the site, the terms “we”, “us” and “our” refer to Maxmyer. While the term ‘you’ refers to the user or viewer of our website. If you are on our website (via mobile, desktop, or tablet) then you are agreeing to be bound legally by these Terms of Use. So, by visiting our website and using the information, resources, services, goods, and tools we offer, you understand and agree to the terms and conditions stated here.

Maxmyer is an online-only store. There is no physical shop that customers can visit. The purchase of Maxmyer online items is subject to these terms and conditions. You agree to these Conditions by placing any orders on this website.

We reserve the right to:

• Modify or remove this website, either temporarily or permanently, and you agree that we won’t be held accountable to you or any other person if we do so.
• Change the terms of use at any time; if you continue to use the website after we make changes, it will be assumed that you agree to such changes.

Online Store Terms

By agreeing to these Terms of Service, you signify that you are at least the age of majority in your state or province of residence. Or that you are the age of majority and have permitted us to enable any of your minor dependents to use this site.

You may not use our goods for any unlawful or unauthorized purpose, and you may not break any local laws while using the Service (including but not limited to copyright laws). You may not send any worms, viruses, or disruptive code. Any breach or violation of these Terms shall result in the immediate termination of your Services.

General Conditions

We retain the right to refuse service to anybody for any reason and at any time.
You understand that your content (except credit card information) may be sent unencrypted and entail (a) transmissions over several networks; and (b) modifications to comply and adapt to the technological requirements of connected networks or devices.

Credit card information is always encrypted when sent across networks. You undertake not to replicate, duplicate, copy, sell, resell, or exploit any component of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is given unless we expressly grant you explicit permission. The headers in this agreement are presented for convenience only and do not limit or influence these Terms.

Registeration

You may register for a Maxmyer account or subscribe to our mailing list for promotional materials if you have an active email account. For account registration, mandatory fields will be the name and email address. For mailing list subscriptions, mandatory fields will be email addresses. Phone number, gender, and date of birth are not mandatory but may be prompted at sign-up.

Account registration and mailing list subscriptions are free. However, we may refuse your application or terminate your registration or subscription for any reason and at any time. You can cancel your registration or subscription at any time and for any reason online by updating your account choices in your customer account on au.maxmyer.com, or by calling our Customer Support at 03 9016 3700.

When you register or subscribe with Maxmyer, you may consent to receive invites, offers, and promotions. If you do not want to be contacted, please use the “unsubscribe” option on these invites, offers, and promotions; however, you will no longer be eligible for discounts and offers reserved for Maxmyer account holders or mailing list subscribers.

To the maximum extent permitted by law, Maxmyer and its related companies and the directors, officers, employees, agents, and contractors of those companies exclude all liability for any loss, damage, cost, expense, or injury (including direct, indirect, special, incidental or consequential loss, loss of revenue, profits, anticipated savings, product will or business opportunity, injury to your reputation) in contract, tort (including negligence), under statute, or otherwise.

Price and Payment

Maxmyer accepts payment via Visa, Mastercard, PayPal, ZIP, Apple Pay, American Express and Afterpay only.

To place an online order, you must pay:

• The corresponding price in Australian dollars, including Australian Goods and Services Tax, is verified by Maxmyer.
• The shipping cost and other charges indicated on the Site were in Australian dollars at the time.

Payments must be collected before orders may be sent. If you fail to make any payments when due, we may cancel this agreement, without prejudice to any other rights or remedies we may have.

You confirm that every payment method you use is your own. Payment methods are subject to validation checks and authorization, and we will not be accountable for any delays or non-delivery caused by the failure of such checks or authorization. Once you have collected and/or received your Goods, you assume all risk of damage or loss.

Shipping and Delivery

We provide free shipping and delivery across Australia. All purchases ordered before 2 p.m. (Monday through Friday) are sent the same day.

Customers who select express shipment (no signature) authorize their order to be left unattended at the delivery address. Maxmyer will only replace purchases shipped via this method if the order was lost in transit by our delivery provider.

The shipping times stated by us are simply estimations. Maxmyer shall not be held liable for late deliveries or any loss or damage resulting from late deliveries. Larger orders may be broken up without notice and dispatched in multiple consignments for convenience of delivery. Tracking information for all shipments will be accessible. We shall not be held responsible if delivery instructions given on the order are overlooked or not fulfilled. For additional details, please see our Shipping Policy.

Deal and Sales

Maxmyer Terms of Use is unable to provide deal prices outside of the specific deal durations. If you buy an item outside of this time frame, it will be at its original price.

• We will not be able to compensate you for the difference if an item you purchased before Sales/Deals becomes available at a lower price.
• Our returns policy allows you to return any purchase, even discounted goods. If you opt to return an item after the sale has expired, the new item will be priced at the original price (unless it is a different size, as explained below).
• To take advantage of the Deals, we recommend acquiring replacement products as soon as possible.
• maxmyer Terms of Use will accept size-only returns at the deal purchase price per our returns policy, provided that the item is in stock and is the same item as purchased (from the same overarching part number). Returning for alternative items is subject to a price difference.
• maxmyer Terms of Use is not able to special order, layby, or raincheck items at the deal price. The pricing is final, with no further discounts.
• Maxmyer is not able to hold items before completing payment. To secure items at the deal price, you will need to pay in full.
• Any products placed in your cart at the offer price during Sales/Deals days will be returned to their original price after the promotion has expired. To secure your basket at a discounted price, check out during the Boxing Day Deals period.
• Any estimates or invoices generated during the offer period will be voided after the promotion expires, and the products will be returned to their original price.

Returns Refunds And Warranty

If you are unsatisfied with your purchase for any reason, we will accept a return for store credit or a refund within 60 days of purchase. The customer must bear all postal expenses associated with returning the item(s); however, Maxmyer will cover return postage for defective products.

Any item returned to Maxmyer will be accepted only once Maxmyer has approved it and a return number has been generated. Maxmyer retains the right to refuse any returned item without notification if we believe the return does not fit the parameters outlined in the return. The client is responsible for the cost of returning rejected items, and Maxmyer maintains the right to hold merchandise until delivery payment is received.

Data Protection

Maxmyer’s policy is to keep all user data confidential, and as such, no data will be shared with other parties. However, data will be made available to Maxmyer employees and Australian Government authorities if legally required.

Termination

If you fail to comply with any of the terms of this Agreement, your rights under it will instantly expire. Maxmyer Terms of Use may also cancel your permission to use the Service at any time, including if Maxmyer finds that your usage breaches any provision of this Agreement or includes fraud or misuse of the Service. In the event of such termination, you shall discontinue all use of the Service, and Maxmyer may immediately withdraw your access to the Service without refunding any costs. Maxmyer’s refusal to insist on or enforce strict compliance with this Agreement does not renounce any of its rights.
